1. Order processing times

Orders are processed within two business days of receipt. Once the purchase has been completed and the order confirmation email has been received, orders will be processed. Delivery times for goods may vary depending on the product chosen, between 2 and 5 days. Processing may be subject to delays during holidays. Orders will be processed and delivered from Monday to Friday, excluding holidays and national holidays. GIST ITALIA SRL is not responsible for unforeseeable delays, it being understood that, except in cases of force majeure, the Products will be delivered within a maximum of 20 (twenty) days from the day following the day on which the Customer placed the order with GIST ITALIA SRL .

The delivery day will depend on the destination location and the availability of the ordered goods. Deliveries are not made on holidays and days before holidays.

2. Cost and delivery methods

Shipments require a period of 3-5 working days. The rates for orders placed on the gist-cycling.com website to all of Italy are as follows:

€10 for orders under €19.99
€5 for orders under €20.00 to €49.99
free for all orders over €50.00
Shipments will be handled by GLS or BRT.

In case of international shipments:

€20 for orders under €99.99
€10 for orders over €100

Times and couriers depend on the destination country

Product deliveries are made to the address indicated by the Customer in the purchase procedure through the carrier throughout the Italian territory with the exception of Campione D'Italia and Livigno. The carrier assumes full responsibility for the transport, from the collection at the supplier, to the delivery to the indicated address. GIST ITALIA SRL assumes no responsibility for any damage or irregular behavior by the carrier.

You can choose the most convenient place as the shipping address: your residence, office or another person's address. The presence of the Customer or his representative at the recipient's address indicated in the order is required for the delivery of the goods.

GIST ITALIA SRL cannot be held responsible for any delays in processing the order or in delivering the items ordered.

Upon delivery the customer is required to check:
- that the packaging is intact, not damaged, not wet, or in any way altered, including the sealing materials;
- that the number of packages corresponds to that indicated in the transport document.

Any damage to the product or packaging or any discrepancy in the indications must be immediately contested to the courier by writing WRITTEN RESERVATION OF CONTROL on the courier's proof of delivery. Once the courier's document has been signed, the Customer will not be able to raise any objection regarding the external characteristics of the goods delivered.

In the event of failure to collect the material stored in the courier's warehouses within 5 working days due to repeated impossibility of delivery to the address indicated by the Customer when ordering, the order will be cancelled.

If any product presented on the portal is no longer available or on sale at the time of conclusion of the purchase transaction, GIST ITALIA SRL will communicate the inconvenience within 15 (fifteen) days from the day following the day of transmission. If the Customer has already paid for the order, GIST ITALIA SRL will provide a full refund of the amount as soon as possible, and in any case no later than 30 (thirty) days from receipt of the purchase order. For security reasons, deliveries to PO boxes will not be made and the order will therefore not be processed.

3. Payment Methods

For each order placed, GIST ITALIA SRL issues a sales document for the material shipped. For the issuance of the invoice, the information provided by the customer at the time of the order is valid. The Customer can request a copy of the invoice or receipt within three months of issuance.

Delivery costs are the responsibility of the Customer and are indicated when placing the order unless otherwise clearly provided in the sales offer.

All prices on the site are intended to be prices to the public and, therefore, inclusive of VAT. Prices may vary without prior notice and the only correct price is intended to be the one indicated at the time of order confirmation.
For certain products, subject to price promotions, the seller reserves the right to accept orders by reducing the quantity, subject to prior communication and acceptance by the customer, failing which the order will be considered cancelled.

In the case of purchase of goods with the "credit card" payment method, at the same time as the conclusion of the online transaction, the relevant banking institution will authorize only the commitment of the amount relating to the purchase made.

Upon request, an invoice for the goods shipped can be issued to the person placing the order, pursuant to Presidential Decree 445/2000 and Legislative Decree 52/2004. The information provided by the Customer at the time of ordering will be used to issue the invoice. No changes to the invoice will be possible after it has been issued.

The goods will be sent only after the order has been accepted and the payment has been received.
In the event of cancellation of the order, either by the Customer (for the reasons set out in the following point 4B) or in the event of non-acceptance of the same by the seller for reasons not attributable to its will, the cancellation of the same will be carried out and the release of the amount committed (the release times depend exclusively on the banking system). Once the transaction has been cancelled, the seller cannot be held responsible for any damages arising from the release of the amount committed by the banking system.

GIST ITALIA SRL reserves the right to request additional documents from the Customer proving ownership of the credit card. In the absence of sending the documentation , GIST ITALIA SRL reserves the right not to accept the order.
The security of transactions is guaranteed by a data encryption system (SSL) and direct, protected and certified connections.

4. Withdrawal & legal guarantee

A. Legal guarantee

The products purchased are always accompanied by a legal guarantee that covers manufacturing defects.
The legal guarantee cannot be asserted by those who have purchased the products in the context of their business or professional activity, indicating their VAT number.
The legal guarantee gives the right to request from GIST ITALIA SRL the replacement of the goods, free of charge, provided that the requested solution is not impossible or excessively expensive, considering: the extent of the defect, the value of the product without the defect and the possibility that the alternative can be implemented without causing significant inconvenience to the Customer;
in the event that the repair or replacement is impossible, excessively expensive or is late or causes significant inconvenience to the Customer and is not effective in solving the problem, the Customer has the right to request a price reduction. In determining the amount of the reduction, the use of the goods must be taken into account. In any case, for minor defects for which it was not possible to proceed with the replacement of the product, it will not be possible to proceed with the termination of the contract.
The seller will replace the product within a maximum of 30 days from delivery.
In order to enforce the guarantee, the Customer must by law:
- keep and display the purchase receipt;
- report the defect within seven days of its discovery;

B. Right of withdrawal

GIST ITALIA SRL reserves the right not to accept goods from the same order, returned and shipped at different times. The costs of returning the goods will be borne by the customer, including liability in the event of loss or damage to the products.

In the event that there is no correspondence between the recipient of the products indicated in the order and the person who made the payment of the sums due for their purchase, the refund of the sums, in the event of exercising the right of withdrawal, will be towards the person who made the payment.

The online customer acting as a consumer is granted the right to withdraw from the contract, as provided for by articles 64 – 67 of Legislative Decree no. 206/2005, known as the Consumer Code.
It is specified that this right is reserved only to natural persons, i.e. to those private consumers who act for purposes outside their profession. There is no right of withdrawal for legal and natural persons who act, in reference to the purchase contract, in a professional context.

Pursuant to and within the limits of art. 64 of the Consumer Code, the consumer has the right, within 14 calendar days of receiving the purchased products, to exercise the right of withdrawal, consisting in the possibility of returning the products received and obtaining a refund of the price paid, without penalty and without the need to specify the reason.

This right applies to all products purchased online on this site.
The costs of returning the product are borne by the consumer.

The right of withdrawal lapses entirely if the returned product is not intact, for example due to the absence of integral elements of the product or because the product has suffered damage for reasons other than transport from the Seller to the consumer, not previously reported.
Without limitation of the right of withdrawal, upon delivery of the product, the consumer, who has reason to believe that the product itself has been damaged during transport, must refuse delivery or accept it with express reservation.

Each collection of intact packages must be made by the customer by writing "INTEGRAL PACKAGE, COLLECTION WITH RESERVATION OF CONTENT CHECK" on the accompanying document (art. 1698 Civil Code). Any anomaly must then be reported within eight days.

Procedure for exercising the right of withdrawal

To exercise the right of withdrawal, it is necessary to send, within 14 calendar days of receiving the purchased product, a communication in which the intention to withdraw from the purchase contract is clearly expressed.
This communication must be sent by registered letter with acknowledgement of receipt.

The communication can also be sent, within the same deadline, by telegram (to the company address).

The consumer must then arrange, using a courier of his choice, for the shipment of the product (if possible in the original packaging and, in any case, always carefully packaged) and all its original contents.
The consumer must make this shipment within fourteen working days from the date on which he sent the communication of exercise of the right of withdrawal.

Important Notes

The transport costs and the responsibility of the goods during shipment, as required by law, are the responsibility of the consumer.
It is therefore advisable to insure the product with the chosen courier, taking care to carefully package the goods, where possible by placing the original packaging in an external box and, in any case, avoiding damaging the product with adhesive tape, labels, etc. The product must be returned intact and complete with all its parts and accessories, including any guarantees. In the event of damage during transport occurring during the return, GIST ITALIA SRL will communicate the damage to the consumer within five working days of receiving the product, allowing the consumer to file a complaint with the courier used for transport. The damaged goods will be made available for return and the request for withdrawal will be simultaneously cancelled. Except as provided below for the case of partial withdrawal, GIST ITALIA SRL will refund, within 14 calendar days from the moment in which GIST ITALIA SRL became aware of the exercise of the right of withdrawal, the entire amount of the purchase and the transport costs for delivery, through a credit card reversal procedure or by bank transfer to the current account indicated by the consumer; the latter will be responsible for the shipping costs for returning the product.

If the withdrawal is partial (i.e. it concerns only a part of the products delivered in a single delivery), the refund of shipping costs incurred by the consumer for the delivery of the products at the time of purchase is excluded.

Order Cancellation Request

The purchase order can be cancelled in full if, at the time of the cancellation request, the shipment of the product is still being prepared and, in any case, if the amount has not yet been collected; in this case, no cost will be charged to the Customer. If at the time of the request to cancel the purchase order the product is already entrusted to the courier or, in any case, the amount has been collected, the consumer must exercise the right of withdrawal and return the goods to GIST ITALIA SRL .
To this end, it is necessary to follow the procedures indicated above for exercising the right of withdrawal.

Each User is prohibited, either for himself or on behalf of someone else:
- use the GIST ITALIA SRL website for illegal, illicit or unauthorised purposes or which may infringe any third party rights, including industrial/intellectual property rights, privacy rights, etc.;
- impersonate someone else, hide your identity, or provide false or untrue information;
- carry out propaganda, sponsorship, advertising or professional commercial activities through the Portal, even indirectly;
- copy, modify, alter in any way any section of the GIST ITALIA SRL website; cause harm to third parties or other Users.
